Terms of sale
Buying resources, clearly explained.
These are the terms that apply when you order downloadable templates, packs and toolkits from us — how orders work, what you can do with the files, and where you stand if something goes wrong.
1. Who these terms are with
These terms apply when you order digital resources — templates, packs and toolkits — from Monday Morning ("we", "us"). They form the agreement between us and the person or organisation placing the order ("you").
You can reach us at contact@monday-morning.co.uk with any question about an order or these terms.
2. How an order is made
The prices and descriptions shown on this website are an invitation to buy. When you complete checkout and pay by card, that is your order.
A contract is formed when your payment is accepted and your order is confirmed by email. If an item is unavailable or a price has been listed incorrectly, we will tell you and refund you in full.
3. Prices and payment
Prices are shown in pounds sterling and are payable in full at checkout.
Payment is taken securely by card at the time of ordering. A receipt is issued with your order confirmation.
4. Delivery
Resources are supplied as downloadable digital files. Depending on the product, this normally includes an editable Word document and a printable PDF, supplied together for download. A download link is emailed to the address given at checkout as soon as payment clears.
It is your responsibility to give us a working email address and to download and save your files promptly. If anything does not arrive or will not open, tell us and we will re-send it.
5. Licence to use the resources
Once paid for, you receive a non-exclusive, non-transferable, perpetual licence to use the resources within your own organisation. You may edit them, add your branding, print them and use them with your own staff, children, families or clients as relevant.
You may not resell, sublicense, share, publish, distribute or upload the resources — in original or edited form — to anyone outside your organisation, including on file-sharing sites, resource marketplaces or social media groups.
We retain all copyright and intellectual property rights in the resources. Nothing in these terms transfers ownership to you.
6. Your right to cancel and refunds
Where you purchase digital content for immediate download, we will ask you to expressly consent to supply beginning immediately and acknowledge that you will lose your statutory 14-day cancellation right once the download begins.
Before payment, you may cancel any order at any time for a full refund of anything already paid.
If digital content is faulty, not as described or does not perform as it reasonably should, you may have rights under UK consumer law. Please contact us at support@monday-morning.co.uk and we will work with you to resolve the issue. Nothing in these terms affects your statutory rights.
7. What the resources are — and are not
The resources are professionally written working documents intended as a starting point. They are not legal, HR, financial or regulatory advice and are not a substitute for advice on your specific circumstances.
We cannot guarantee that using a resource will make your organisation compliant with any law, regulation or inspection framework, including employment law, the EYFS or Ofsted requirements. Law and guidance change; you are responsible for checking that a resource is current, suitable and correctly applied in your setting before you rely on it.
8. Our liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for loss of profit, loss of business, loss of contracts, regulatory penalties or any indirect or consequential loss arising from your use of the resources. Our total liability for any order is limited to the amount you paid for that order.
If you are a consumer, your statutory rights are unaffected by these terms.
9. Changes to the resources and these terms
We may improve or update resources over time. Updated versions are not automatically supplied with earlier purchases unless we say otherwise.
We may change these terms from time to time. The version published on this page when you place your order is the version that applies to that order.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
